Florida Residency Requirements

Determines whether a student qualifies for in-state tuition rates or must pay out-of-state tuition. Residency for tuition purposes is based on legal domicile and supporting documentation, not intent alone.

What is Residency?

Florida law (Rule 6A-10.044, F.A.C.) requires Lake-Sumter State College (LSSC) to determine whether a student qualifies for in-state or out-of-state tuition. Residency for tuition purposes is based on legal domicile and supporting documentation, not intent alone. 


Key Rules to Remember

  • All students are initially classified as non-residents for tuition purposes. 
  • Living in Florida or attending a Florida school does not automatically qualify a student for in-state tuition. 
  • Residency determinations are not retroactive. 
  • The burden of proof rests with the student or parent/guardian. 

Step-by-Step Residency Process

  • Step 1 – Initial Classification: Upon admission, all students are classified as non-residents. 
  • Step 2 – Submit Residency Information: Students seeking Florida residency must submit a Residency Declaration and required documents by the published deadline. 
  • Step 3 – Citizenship or Lawful Presence: The student must provide proof of U.S. citizenship or lawful presence. Parents or guardians are not required to submit this documentation. 
  • Step 4 – Dependent or Independent Status: The College determines whether the student is dependent or independent for residency purposes, which determines whose documentation is reviewed. 
  • Step 5 – Documentation Review: Enrollment Services reviews documentation to determine whether clear and convincing evidence of Florida domicile has been provided. 
  • Step 6 – Notification: Students are notified of their residency determination through official LSSC communication channels. 
  • Step 7 – Tuition Assessment: Tuition and fees are assessed based on the residency determination for the applicable term only. 

Documentation Basics

Students must submit two qualifying residency documents dated at least 12 months prior to the first day of classes. At least one document must demonstrate strong legal ties to Florida. 

Acceptable Documentation (Examples) 

  • Florida driver’s license or state ID 
  • Florida voter or vehicle registration 
  • Proof of permanent Florida employment 
  • Lease or mortgage showing long-term Florida residence 

Unacceptable Documentation (Examples) 

  • Bank statements 
  • Utility, cable, or cell phone bills alone 
  • Insurance or medical bills 
  • Documents created solely for school enrollment 

Reclassification for Future Terms 

Students initially classified as non-residents may apply for reclassification for a future term by submitting updated residency documentation. Reclassification is not retroactive.
